TERMS & CONDITIONS

Photography by Jacquelyn (“we,” “us,” or “our”) provides photography services in Los Angeles, California. These Terms and Conditions (“Terms”) govern all bookings, services, transactions, and interactions between us and our clients (“you” or “client”).

By booking a session, you acknowledge that you have read, understood, and agree to be bound by these Terms.

We provide professional photography services, including but not limited to portrait, event, lifestyle, family, and commercial photography. Specific details, deliverables, and timelines will be outlined in each individual booking agreement or email confirmation.

3. Booking, Deposits, and Payments

3.1 Booking Deposit

A refundable deposit of 35% of the final total is required at the time of booking to secure your appointment.

3.2 Final Payment

Final payment is not required before your scheduled session, but your photos will not be delivered until full payment has been received.

3.3 Accepted Payment Methods

We may use third-party payment processors (e.g., PayPal, Stripe, Square, etc.). By making a payment, you agree to their respective terms and policies.

4. Cancellations, Rescheduling, and Refunds

4.1 Cancellations by Client

  • Cancellations must be made at least 48 hours before the scheduled appointment to receive a refund of your 35% deposit.

  • If your session is booked within 48 hours of your appointment, the 35% deposit is non-refundable, regardless of cancellation time.

4.2 No-Show Policy

Failure to arrive within 20 minutes of the scheduled session time without prior communication will be considered a no-show, and payments made may be forfeited.

4.3 Cancellations by Photographer

If we must cancel due to illness, emergency, unsafe conditions, or unforeseen circumstances, you will be offered:

  • A rescheduled appointment at no additional cost, or

  • A full refund of all payments made, including the deposit.

5. Rescheduling

Clients may request rescheduling up to 48 hours before the session start time. Requests within 48 hours are subject to approval based on availability and may require a new deposit.

6. Delivery of Photos

Standard turnaround times vary depending on the session type and will be stated in your booking confirmation.

Photos will not be delivered until full payment has been received.

Final edited images will be delivered via an online gallery or delivery method specified at the time of booking.

7. Copyright and Usage Rights

7.1 Photographer’s Copyright

All images taken by Photography by Jacquelyn are protected by copyright law. We retain full copyright and ownership of all photographs.

7.2 Client Usage Rights

Clients receive a personal-use license allowing printing, sharing, and posting online for non-commercial purposes.
Commercial use requires a separate agreement.

7.3 Photographer Portfolio Use

We reserve the right to use any photos from your session for marketing, social media, website galleries, and promotional materials, unless both parties sign a written agreement opting out.

8. Client Responsibilities

Clients must:

  • Provide accurate contact and appointment information.

  • Arrive on time and prepared for the session.

  • Obtain any required permissions for locations (e.g., permits for public spaces).

  • Ensure all participants portrayed in the photos consent to being photographed.

9. Limitation of Liability

We are not liable for:

  • Delays caused by weather, traffic, location restrictions, or emergencies beyond our control.

  • Loss or damage to images due to technical failure, unless caused by our negligence (in which case our liability is limited to a refund of the fees paid).

10. Privacy and Data Collection

We collect personal information such as your name, email, phone number, and payment details solely for booking and service delivery purposes. We do not sell or share your information except with trusted third-party service providers necessary to complete your transactions.

11. Third-Party Services

We may use third-party services, including payment processors, gallery hosting platforms, or cloud storage providers. We are not responsible for the actions or policies of these third parties.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in courts located in Los Angeles County, California.

13. Changes to Terms

We reserve the right to update or modify these Terms at any time. Updated versions will be posted on our website or provided at the time of booking. Continued use of our services constitutes acceptance of the updated Terms.
